Terms of Service

Agreement and scope

These Terms govern Modoto Studios accounts and the website, including store reservations, bookings, services, Academy features, Loyalty, Tokens, XP, events, the physical Terminal, and XO Web. By creating or using an account, you agree to these Terms and any supplemental terms presented for a feature.

A general Modoto account does not guarantee eligibility for, admission to, or continued access to XO Web.

Account eligibility and accuracy

You must provide accurate account information, keep it current, and use only an account you are authorized to control. General Modoto accounts may be used for ordinary store, booking, event, or Academy functions subject to the applicable rules. XO Web is separately restricted to adults who affirm they are at least 18, accept the current XO terms and community rules, and receive an explicit XO access grant.

Account security

You are responsible for protecting your credentials and devices. Do not share passwords or authentication links. Report suspected compromise promptly. Modoto may restrict sessions or require recovery steps when reasonably necessary to protect an account or the service.

Acceptable use and prohibited conduct

Do not misuse the service, attempt unauthorized access, disrupt systems, evade restrictions, scrape private data, impersonate others, harass or threaten people, distribute malware, commit fraud, infringe rights, or use Modoto to facilitate illegal activity. Supplemental Community Rules apply inside XO.

Suspension and termination

Modoto may limit, suspend, or terminate access for safety, security, legal, operational, payment, policy, or abuse reasons. Where appropriate, the user may receive notice and an appeal route. Emergency restrictions may be applied before notice when delay would increase risk.

User-submitted material and intellectual property

You retain ownership of material you submit. You grant Modoto a nonexclusive license to host, reproduce, format, display, transmit, moderate, preserve, and otherwise operate that material as needed to provide the requested feature and enforce the published rules. You must have the rights needed to submit the material.

Modoto names, branding, site code, original graphics, and other Modoto materials remain owned by Modoto or their respective licensors.

Service availability and third parties

Features may change, pause, remain in testing, or be withdrawn. Cloudflare, Supabase, payment providers, email providers, and other third parties may support the service under their own terms. Modoto does not promise uninterrupted or error-free operation.

Reservations, bookings, services, and events

A store reservation is a temporary hold, not a completed sale. Bookings and service requests are requests until accepted. Additional policies govern holds, estimates, deposits, cancellations, repairs, creative work, lessons, venue use, and events.

Loyalty, Tokens, and XP

Tokens and XP are promotional account features, not cash, deposits, securities, stored value, or property transferable outside the program. They may be corrected, reversed, limited, suspended, or retired for error, abuse, legal, or operational reasons under the published Loyalty rules.

Disclaimers and limitation of liability

To the extent permitted by law, the service is provided as available without warranties beyond those that cannot legally be excluded. Modoto is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Any direct liability is limited to the amount paid for the specific transaction giving rise to the claim, except where a different limitation is prohibited by law.

Indemnification

To the extent permitted by law, you agree to defend and indemnify Modoto from third-party claims caused by your unlawful conduct, infringement, misuse of the service, or breach of these Terms.

Washington law and disputes

Washington law governs these Terms, without regard to conflict-of-law rules. Before filing a non-emergency claim, the parties should provide written notice and make a good-faith effort to resolve it. Nothing here prevents either party from seeking urgent injunctive relief or using a legally available small-claims process.

Changes and contact

Material changes will receive a new version and may require renewed acceptance. Formatting or spelling corrections may not. Contact Modoto through the Contact page.
