Required notice elements
A notice should identify the copyrighted work, identify the allegedly infringing material and its location, provide the complaining party’s contact information, state a good-faith belief that the use is unauthorized, state under penalty of perjury that the information is accurate and that the sender is authorized to act, and include a physical or electronic signature.
Removal and evidence log
Modoto may restrict material while reviewing a sufficiently complete complaint. The service records the notice, affected material, preservation snapshot, actions, notifications, and outcome. Knowingly false notices may cause harm and liability.
Counter-notification
A counter-notice should identify the removed material and prior location, provide the subscriber’s name, address, and telephone number, include the required good-faith and jurisdiction statements, and include a signature. Modoto may forward the counter-notice to the complainant as permitted by law.
Repeat infringers
Accounts responsible for repeated infringement may lose upload, posting, XO, or account access after appropriate review.
DMCA agent status
Modoto is preparing designated-agent registration and public directory information. Until registration is completed and verified, Modoto does not represent that the statutory designated-agent process is fully operational or that safe-harbor eligibility has been established.
